We told you a couple of weeks ago about how LuAnn Bennett, former wife of former Virginia Congressman Jim Moran (D-VA8), was going to be tapped as the Democratic nominee to take on presumptive Republican nominee, Rep. Barbara Comstock, in Virginia’s 10th District next year.
As we previously reported, Ms. Bennett lives in Washington, D.C., though she maintains a residence in Fauquier County (in Virginia’s 5th Congressional District). Despite this, and despite knowing she was registered to vote in the 5th District, Democrat power brokers in Northern Virginia have chosen her to be the next nominee to take on Comstock.

Sometime within the next two weeks the 10th CD Committee and LuAnn Bennett will announce her candidacy to run against Comstock. LuAnn is a registered voter in Delaplane, Fauquier County, 5th CD. I’m aware that Article I, Section 2 of the Constitution requires only that the Representative shall “be an inhabitant of that State in which [s]he shall be chosen.”

(Emphasis added). Yes, they understand that she owns a business in DC and lives in DC, but are relying on the fact that she’s registered to vote in Virginia–even though it’s outside the 10th District. All perfectly legal, if she actually is “an inhabitant” of Virginia.
This will explain why Ms. Bennett put her condo at the Ritz-Carlton in DC up for rent, for the measly sum of $7,500 per month. For RENT. Because she knows she won’t be out of town for long. Apparently she’s gotten a temporary place in McLean, near where Comstock lives.
Bennett made her announcement earlier today.
An NRCC spokesman summed it up best:
“Barbara Comstock is doing such a great job representing her Virginia constituents that Democrats have resorted to a fifth-tier candidate who doesn’t even live in the commonwealth,” said NRCC Spokesman Chris Pack.

Well this is good news for the 10th. They will now have a choice of 2 Democrats one with an R behind the name. Really who are you supporting. If you art voting for a Democrat why not vote for the one that acknowledges who she is.

Guess so, haven’t seen any “amnesty ” bills. Not since like 86-87
you do understand the trade off if we fund this you don’t issue this executive order, right. That was the magic bullet republicans had at the time to stop Obamas amnesty orders. Instead of shutting down DHS which did not help us in California it gave the president 1.7 billion dollars to use for illegal aliens. Not my PC. You accused her of voting for amnesty. Yet nothing that shows that anyone will automatically become citizens. I want to see a link to a bill that guarantees amnesty to anyone.

I checked §24.2-500 (State Election Law) and it says that she must be a resident of VA for 1 year and be able to vote in the district for which she is running. So, as long as she was registered in CD 5 prior to last November and has a place in CD 10 to re-register, she would be legal. Unless the Federal Election Law has something that prevents it.
She can live in the 5th and run for the 10th without moving. Case in point, Morgan Griffith ran for the 9th while living in the 6th. His house was redistricted into the 9th the following year.
Except she hasn’t lived in the 5th. Until VERY recently she has lived in the District, which is not part of the Old Dominion.
The law is so vague that the SBE would probably look the other way just because she is registered to vote in the 5th.
We had an incident a few years ago where a politician was redistricted out of his district but did not want to move out of his spacious mansion. To run to keep his seat, he “rented” a small cabin from a friend in the district. He never resided there, but did so on paper to be able to run for his incumbent seat.
Just because she could doesn’t mean she should. The 10th likes our own, we have standards for carpetbaggers — within the 10th district is cool, outside… not so much.
I agree. I don’t think she should run for the 10th even though it is legal for her to do so. It’s not like she lives right on the district line.
This is why I think she’s the placeholder candidate, Barbara should ignore her posturings and just use her for fundraising.
State law explicitly states that to run for an office, you must be able to vote for that office. She would need to be registered to vote in the 10th in order to run for the 10th. So, to live in the 5th, she would also need a residence in the 10th and register there. Also, she would need to have been registered somewhere in VA prior to last November to meet the 1 year residency requirement.
I’m not sure who told you that is the law, but here are the qualifications for running for Congress in 2014:
III. QUALIFICATIONS TO BE A CANDIDATE
A candidate must be:
1. At least twenty-five years of age by the time of taking office;
2. A citizen of the United States for at least seven years; and
3. An inhabitant of the Commonwealth he seeks to represent.
Unless they changed between last year and this year, there is no requirement to be able to vote for the position you’re running for when it is a seat in the House of Representatives. I live in Salem, and even I could run for the 10th if I wanted to.

I think I found the law you’re referring to.
§ 24.2-500 in the Virginia code does state that to qualify as a candidate for any office of the Commonwealth, or of its governmental units, a person must be qualified to vote for and hold that office. That law applies to state and local offices. It does not apply to federal office.
