On Monday, July 28th, the 4th Circuit Court of Appeals struck down Virginia’s Constitutional Amendment banning gay marriage. On Friday, August 1st, attorneys for Michele B. McQuigg, Clerk of the Court for Prince William County, requested a stay of that decision while it is appealed to the Supreme Court. Without that stay, McQuigg and the other county clerks throughout Virginia would be required to issue marriage licenses for gay couples within 21 days. The ruling effects five states, Virginia, West Virginia, Maryland, North and South Carolina. It is expected that the 4th Circuit will agree to the 90 day stay, allowing McQuigg’s attorneys the time needed to file an appeal with the Supreme Court. The appeal will be filed by October 26th.
