Within the past few days President Trump granted clemency to Tina Peters, a nearly 70 year old woman who was tried and imprisoned by the State of Colorado. Her state crime was keeping election records and comparing them to posted election results in the 2020 national election.
The legal beagles supporting the incarceration of Peters have said that Trump has no business pardoning someone involved in a state crime. However, this is not just a state crime but a federal election fraud crime. The legal situation is not cut and dried.
Peters is being kept in prison by the people who had most to gain by the federal election fraud crime. Arguably, the Governor of Colorado, Attorney General, sentencing Judge, and those who handled the election could be criminal conspirators; it is more than troubling that they are holding the star witness against them in a state prison.
Tina Peters is in great danger and needs to be removed from Colorado. Reports of mistreatment by prison authorities and the physical decline of Peters who is fighting cancer provide evidence of the dangers.
The federal Department of Justice needs to act quickly. If this involves sending US Marshals to free Peters, so be it.
Note: This reminds me of the situation that led up to the Battle of Athens, Tennessee in 1946 where a corrupt local town government was overthrown by citizen force of arms.

Governors can issue pardons with respect to state crimes. The President of the United States can issue pardons with respect to federal crimes. Pardons issued by governors have no legal effect with respect to federal crimes. Pardons issued by the President have no effect with respect to state crimes. Even if there were a reasonable basis for concluding Ms. Peters was unfairly or unjustly convicted of a state crime, what legal basis is there for federal intervention? A federal pardon would not provide a legal basis for federal intervention. If a case could be made that Ms. Peters is being denied her federal rights under color of state law, then there might be basis for filing a habeas corpus action in federal court.
The election fraud discovered by Tina Peters was federal election fraud. That is the crime, and that is a federal crime.
She needs to stay right where she is. If she had been a Democrat who violated the security of voting equipment, you clowns would be calling for her execution and you know it.

That accusation warrants an investigation. That is the stuff that goes on in the PRC and Russia. It is time to stop this kind of abuse of power to attack people.
Having read several articles, over the years from this author, i have every reason to believe it has been prudently researched.
There is a 70 year old woman sitting in a state prison because the elected leadership of Colorado doesn’t want election discrepancies investigated. There is information that the Biden administration was also gaming the Peters issue fearing an investigation would not be good for the Democrat party or, worse, would trigger a full-blown national election investigation. As far as abuse of power, you have one hell of a nerve talking about abuse of power after what Democrats did to Trump and his key advisors. I suggest you suck it up before you start throwing these kinds of implie threats around. For some reason, I doubt you want this pursued as it is likely to uncover some very uncomfortable under the table political issues.
