The Supreme Court has sided with Texas on their law that makes it a crime for illegals to enter the United States. That means Texas law enforcement will be allowed to arrest any illegal immigrants who have crossed into Texas from Mexico. That is necessary because the federal government has not enforced the federal law to keep them out of Texas. So Texas will. Read more below from Texas Attorney General. It’s a huge win for Texas.

The law, known as S.B. 4, makes it a state crime for migrants to illegally cross the border and allows Texas officials to deport undocumented individuals. It was passed last year amid a record surge in border crossings — part of Gov. Greg Abbott’s (R) push to expand the state’s role in immigration enforcement, which historically has been a federal responsibility.
The Supreme Court’s decision was divided and preliminary, with two justices in the majority urging a lower court to quickly decide whether to allow the law to remain in effect while appeals continue. The order drew dissent from the three liberal justices, two of whom said the majority was inviting “further chaos and crisis in immigration enforcement.””
Texas state Attorney General is thrilled:
“Texas Attorney General Ken Paxton called the high court’s order Tuesday a “huge win,” and a defeat for the Biden administration, and said the state law is “now in effect.”

Anyone accused of reentering the country illegally could face felony charges. To me it is phenomenal why we are even having this border security discussion. The laws of the land are (almost) clear with regard to the duties of the Gov’t in protecting our territories from unauthorized & Illegal entry. This is why we have required a Visa, approval for temporary entry, from some country’s citizens to visit our country. And made their visit – time limit – agreements with other countries who don’t need Visas. IF you overstay your Visa or max out time limit to visit the U.S.; or if you enter from a border or waterfront, without entry approval, then you are breaking the law. Moreover, imagine the long, long, walk from Southern Mexico to Southern U.S., to ask for asylum when arriving. Most are going across three or more countries, who could provide that asylum…
Note: Almost all passports issued by countries, we accept visitors from, are designed to validate the identity of the holder. [forget the movies & fake passports] Moreover, they are scrutinized by U.S. Immigration officers at the airports, cruise terminals, and specified entry points. Those immigration officers do a pretty good job at reviewing the passports & holder of the passports when presented to them. And today we are tracking those entries and exits via Data Bases, which receive entry from facial recognition software.
It’s a good question; but it has to do with the exact “laws of the land” that you reference here.

People who are physically in the country – even if they illegally crossed the border to get here – have a right to claim asylum. This right was passed by Congress and is the law of the land. Attempts to end this right by Executive Order (as both Trump and Biden have tried to do) have been slapped down by the Courts. It requires legislation to change it; but House Republicans refused to consider a bill to change it, due to Trump’s opposition (he wants things to remain as they are so he can run on it in 2024).

Once they claim asylum, the government is supposed to detain them while they await a hearing. However, very little resources have been authorized by Congress to make this happen effectively. Congress has only funded ~63K beds; we have many more migrants coming in each month than that. There are also legal limits on how long children and families can be detailed. We also face a years-long backlog in hearings.

Again, House Republicans have steadfastly refused to authorize more funds for detention, and vehemently opposed authorizing more funds for immigration judges to speed up hearings and clear the backlog. So without the physical ability to detain everybody, Presidents grant parole (often called “catch-and-release”). Biden does this. Trump did this. Every President has to, because Congress refuses to pass anything to fix or fund the current problem.

To make matters even worse, these paroled migrants don’t have work authorization, meaning it is illegal for them to financially support themselves, as legal immigrants (even poor ones) are able to do. So they try to find sponsors and NGOs to take them in, but most are left to rely on government services. Also, Texas and Florida Republicans have started suing charities who help house and feed migrants, and even suing churches who open their doors to the needy, putting even more stress on government services for a problem Congress refuses to address.

You have to apply for asylum in the first country you come to that is also a signee. Mexico is. The whole system needs a complete overhaul… first of all getting rid of the family preference visa system in favor of a merit based once. Codifying without a doubt that you have to apply for asylum in Mexico or any safe country. You cannot shop for the best welfare system. And a stream lined process… yes you get detained and you get a hearing in a week and you are back across the border.
Finally being subject to crime IS NOT a grounds for asylum. that needs to be put in black ink in the law. If so you should get asylum if you live In Chicago.

Safe Third Party Agreements can work, if the foreign government agrees to it and they are actually, you know, safe. As of right now, we have an agreement with Canada. You could change the law to require a rule that we don’t allow asylum seekers who pass through another country, but you’d need legislation to do that. It’s difficult to imagine Republicans agreeing to any border legislation anytime soon, or finding a bill that can get 60 votes in the Senate.

Trump did pursue this route, but only was able to get an agreement signed with Guatemala (stretching the definition of “safe”), and it only ever applied to a few hundred migrants before they shut things down due to COVID-19. Trump left an unsecure border in chaos, which Biden took over in January 2021.

We are agreed the system needs overhauled; what we have right now is broken and not working the way it was intended. I am concerned with some of your other ideas, though. Limiting legal immigration will just increase the demand for illegal immigration. We need far more legal immigration than we have now; most people who cross the border to claim asylum do so because there is no other legal path available to them. Making it easier for people to come here and grow our economy is a win-win for everyone, and is the only thing actually proven to reduce the flows of illegal migration.

Neither moved to stop the illegal immigration, and they will not in the future. Trump did not do what he said he would in his first term, he will not in his second term. 1) Illegals can still march across the border even with SB4 in effect. In fact, they can even still apply for asylum, which Congress gave them the right do to via legislation. This law cannot be undone by Executive Order — both Trump and Biden attempted to do so, but Courts blocked them. The only thing that can change this is new legislation. Unfortunately, the bi-partisan deal to help address the issue that Biden struck with Senate Republicans got blocked because House Republicans wanted to Trump to run on it as a political issue.
2) SB4 wouldn’t stop anything from happening at the border; it would just allow Texas officials to arrest people who are already here. They find somebody (could be a migrant, could be a Dreamer, could be a US citizen, could be a Virginian tourist visiting the state), and if the official says that they believe the person crossed the border illegally, they arrest them and offer a choice: deport yourself to Mexico or face up to 20 years in prison and stay in jail while you await your trial date.
2) There are roughly 11 million undocumented noncitizens in the country, but the overwhelming majority of those are people who overstayed a visa, not migrants. While both Biden and Trump (and Obama and Bush) have used catch-and-release, this is due to Congress refusing to pass funds to allow for enough detention space to hold all the migrants we catch. But, again, House Republicans are opposed to taking any action at the border because it’s politically advantageous to do so.

Thanks for the update, Jeanine. A few corrections to facts you got wrong:
1) First and foremost, SCOTUS didn’t “side” with Texas. The 5th Circuit issued an “administrative stay”, rather than a formal stay; SCOTUS sent it back to the 5th to complete their review on an actual stay. SCOTUS has made zero determination of the merits of the law.
2) The sentence “made it a crime for illegals to enter the US” is a disaster of a sentence. Illegal entry is already a federal offense. Those caught are put into removal hearings. Those removal hearings can be paused if a migrant claims asylum, a right established by Congress. The Texas law says that Texas police can arrest anyone they suspect entered the country illegally, slap them with a felony charge and threaten jail time, or offer them to deport themselves to Mexico (regardless of whether they actually did enter illegally or not; or have federal protection from deportation or not).
3) To that point, it doesn’t allow Texas to arrest “attempted” crossers. It allows Texas to approach any person inside Texas and arrest them due to suspicion of having previously entered illegally.
