Will Obama install a new justice to the Supreme Court? Congress is in recess until February 22, giving Obama 9 days to install a new justice to the court. Such an appointment by a President hasn’t happened since Eisenhower. Obama has made recess appointments in the past so it wouldn’t be a complete surprise if he did it again. Perhaps Obama will install a Protestant to add some diversity to the court. More on the possibility of a recess appointment here and here. Law Professor Jonathan Turley calls the idea of a recess appointment to the Supreme Court a ‘perfectly horrible idea’.
