Yesterday afternoon a Tazewell County Judge ruled that the Democrats in Richmond acted in both an illegal and unconstitutional way when the passed in October 2025 a Constitutional Amendment to return gerrymandering to Virginia. For those of you not familiar with passing a constitutional amendment in Virginia, the Legislature has to pass the amendment in 2 successive years, with a state “intervening election” in between. Democrats passed the 1st part in October 2025, and then tried to say that passing so in 2026 (after the November elections) would pass muster.
Tazewell Circuit Court Judge Jack Hurley determined that what the Democrats did was both illegal and unconstitutional, and tossed the Democrats naked power grab.
Judge Hurley in his ruling said and I quote:
“There is no rational conclusion except that the ELECTION began on the first day of voting (September 19, 2025) and ended on November 4, 2025,” Hurley wrote. “Therefore, the Court FINDS that following the October 31, 2025 vote and passage of [the redistricting amendment] HAS NOT BEEN an ensuing general election of the House of Delegates.”
This is not over by a long shot. Democrats will appeal this to the Virginia Supreme Court – but it is not likely they will prevail. Democrats tried to deny 850,000 Virginians their right to know what was on the ballot in 2025, and that will never end well. This fight is not over, however it is clear that the Democrat Party has clearly violated the spirit and word of the Virginia Constitution.
This is also a reminder that each Virginia city and county other than Arlington supporting non partisan redistricting overwhelmingly.
Virginia’s 6th Congressional District Republicans thank Judge Hurley, Virginians for Fair Maps, and the plaintiffs in this case for standing on principle and the rule of law. Virginia’s 6th Congressional District Republicans also call for Democrats to keep their promises on “affordability” in the 2025 campaign and to stop legislation on issues that will only harm Virginians and make life less affordable.

I was mistaken on my first comment. I thought that this was a Federal Judge and that the 4th Circus would get involved. My bad. I’m hopeful that the VA Supremes will render the correct judgement. I was amused by one of the respondents to my first comments excoriating the Republicans for “hand picking” the judge. I asked him or her or it if it was perfectly fine when the democrat traitors judge shopped to find judges to interfere with trumps Eos but somehow not OK if the Republicans did it? No response.
