Delegate Joe Morrissey, who spends his days in the House of Delegates under a work release program and his nights in jail, has voted against Delegate Steve Landes’ bill to ban pornography in jails. [read_more](You can’t make this stuff up.) HB 1958 will ban “the possession of obscene materials by prisoners incarcerated in state correctional facilities”. Morrissey said,
“The reason I voted ‘no’ is because I don’t believe the bill if challenged in court would survive a constitutional challenge. The bill does not describe what obscene materials is,”
The bill passed easily with a vote of 86-13.
“For all practical purposes we’ve done everything but expel him,” said Speaker Howell.
Delegate Morrissey returns to court on Monday to face four felony charges including forgery and perjury.
