Is Medicaid Expansion in Store when the General Assembly Reconvenes Tomorrow?

written by Paul A. Prados September 17, 2014

The General Assembly reconvenes tomorrow September 18, 2014 ostensibly to discuss Medicaid expansion.  The most likely result is that dozens of individuals and organizations will be commended, and little else will occur. [read_more]

The Rules

The General Assembly, when meeting in Special Session, may only address those items agreed to in the rules.  We have had rules for this special session but those rules are likely to be changed tomorrow.  This week Del. Kirk Cox introduced HJ 5208 which likely sets the scope of topics for the special session as:

“those relating to (i) providing health insurance coverage or medical assistance services to indigent Virginians; (ii) Budget Bill(s); (iii) joint resolutions or resolutions affecting the rules of procedure or schedule of business of the General Assembly, either of its houses, or any of its committees; (iv) bills, joint resolutions, or resolutions regarding the election or funding of justices, judges, and other offices elected by the General Assembly; (v) commending and memorial joint resolutions or resolutions; or (vi) joint resolutions or resolutions confirming appointments subject to the confirmation of the General Assembly”

In simpler terms: 1) Possible Medicaid expansion; 2) The budget; 3) Procedural rules; 4) Selecting and funding judges; 5) providing accolades to citizens and groups; and 5) Confirming appointments to parts of Virginia government.

The only difference between the new rules and the old rules is that the new rules address issues of possible Medicaid expansion.

Budget changes

Monday of this week Governor McAuliffe along with leaders in the General Assembly held a joint press conference announcing that a deal was reached on cutting the budget.  These cuts are mostly done in the form of block deductions (the opposite of block grants) where the entity whose budget is cut gets to be the bad guy and decide which of its own programs and expenses to cut.  These bills are highly likely to pass given their precleared nature with both political parties.  The text of the bills can be found at: HB5010 and SB5005.

Given their last minute emergency nature, Steve Albertson is right to doubt the purpose of the budget bills.  This whole debate sounds a lot like the federal government dealing with raises to the debt ceiling.

Medicaid expansion

Conventional wisdom says that Medicaid expansion is a nonstarter as nothing can pass the House.  As conventional wisdom in politics is often wrong, conservatives should be on guard about measures that have been proposed.

As I relayed last week, Del. Tom Rust has offered the primary bill to expand Medicaid.  Gov. McAuliffe has come out in support of Rust’s bill.   It is being pushed as if it is a long term solution to assist with the coverage gap and claim federal whatapartydollars without expanding Medicaid.  In reality it appears to be an all but inevitable system for expanding Medicaid.

Del. Dave Albo has submitted a bill to bring Virginia law into conformity with a number of other state’s laws.

Del. James Lemunyon has just offered a bill requiring the Medicaid Innovation and Reform Commission [“MIRC”] to submit a report with recommendations by the end of the year.  Nothing MIRC recommends would be binding.  Nonetheless, this looks like a system for the specially selected members of MIRC to keep the issue of Medicaid expansion alive for the 2015 session.

Reassertion of power by the G.A.

As I outlined last week, the General Assembly was set to pass a weaker grant of authority to Speaker Howell to hire counsel to defend the Commonwealth.  Del. Mark Cole has now introduced new legislation (HR566) that is specific in the purposes of hiring counsel, namely to defend the Virginia Constitution in the challenge to the marriage amendment, and to challenge any unilateral expansion of Medicaid by Gov. McAuliffe.  Arguably, this is germane under the rules as it is a resolution about Medicaid.

Paul A. Prados

Having fallen prey to the allure of DC politics in college, Paul escaped only to make the similar judgment error of going to law school. Trained at the side of a sitting state Senator, Paul is now the owner of a law firm in Reston, Virginia. In previous years Paul built a base of support on Twitter @ppradoslaw and founded and wrote for a blog on Virginia politics and legal procedure northernvirginialawyer.blogspot.com. As a pro-life libertarian, Paul finds himself at home within the broader conservative movement, and believes in a big tent Republican Party. In May 2016 Paul was elected as Chairman of the 11th Congressional District Republican Committee. Paul resides in western Fairfax County with his wife and children.
